These Terms of Service ("Terms") govern your access to and use of hirelocaltrades.com ("the Site"), a service directory platform owned and operated by Trail Mark Digital LLC ("TrailMark," "we," "us," or "our"), registered in Utah. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
Hire Local Trades is a service directory platform that connects consumers with local service providers across various trades and industries. The Site provides listings, contact information, and lead generation services. All content on the Site is created, managed, and owned by Trail Mark Digital LLC.
All content on the Site -- including but not limited to text, graphics, logos, images, page designs, listing content, phone numbers, domain names, data compilations, software, and all other materials -- is the exclusive property of Trail Mark Digital LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site without the prior written consent of Trail Mark Digital LLC.
All lead data generated through the Site -- including but not limited to form submissions, phone call records, text message records, email inquiries, and any other consumer contact information or service requests -- is the sole and exclusive property of Trail Mark Digital LLC. This applies regardless of whether such leads are forwarded to, accessed by, or acted upon by any third-party service provider.
Certain listings on the Site may be managed on behalf of local service providers who rent the listing space from Trail Mark Digital LLC. These listing rental arrangements are governed by separate agreements between TrailMark and the service provider.
Notwithstanding any such arrangement:
All phone numbers displayed on the Site are owned and controlled by Trail Mark Digital LLC. These numbers may be tracked for analytics, quality assurance, and lead attribution purposes. Calls placed to these numbers may be recorded. By calling any number listed on the Site, you consent to such recording to the extent permitted by applicable law.

The Site and all content are provided on an "AS IS" and "AS AVAILABLE" basis. Trail Mark Digital LLC makes no warranties, express or implied, regarding the Site, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee the accuracy, completeness, or reliability of any listing, service provider information, or content on the Site. We do not endorse, warrant, or guarantee any service provider listed on the Site. You are solely responsible for evaluating and selecting any service provider.
To the fullest extent permitted by law, Trail Mark Digital LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, regardless of whether we have been advised of the possibility of such damages.
In no event shall our total liability exceed one hundred dollars ($100.00).
You agree to indemnify, defend, and hold harmless Trail Mark Digital LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or your violation of these Terms.
The Site may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of any third-party sites and do not endorse them. Your use of third-party sites is at your own risk.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.
We reserve the right to suspend or terminate your access to the Site at any time, for any reason, without notice or liability.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and SMS Terms, constitute the entire agreement between you and Trail Mark Digital LLC regarding your use of the Site.
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Utah.
